- Garcia was reversed by the en banc Ninth Circuit. Judge Kozinski remained in dissent, and neither side did itself any real credit in the final opinion (PDF).
The real problem remains that this is a copyright case only because the schmuck of a producer (Judge Kozinski's words) didn't follow copyright law in the first place. So it's doubly his fault: What he did appears to have breached some particularly difficult to present, heavily fact-laden legal rights (false light publicity; unfair trade practices and fraudulent inducement of contract) while waving the attractive nuisance of copyright's strict liability procedural posture in everyone's face. I thereby propose that he (and any general counsel who advised him concerning his procedures, as opposed to the counsel who represented him in this matter) be remanded to the custody of the the Ludovico Institute, where he shall be forced to watch offensive videos for an uninterrupted period of fifty (50) hours.
Yeah, I suppose I've got a mean streak.
