Well, I guess I lose that bet. Sort of. I predicted that Grokster would not be granted certiorari by the Supreme Court, or at least not on the ground that it creates a "circuit split" with the Seventh Circuit's decision in Aimster. The Court just granted cert.; but, as usual, does not state why. After reading the petition, though, I don't think it was on the basis of the purported circuit split.

If you care about the state of the law, start here — Howard's commentary is far better balanced, better informed, and better considered than any of the media outlets.
